Is Obamacare Constitutional?

Good Question. Bill Clinton might answer that it depends on your definition of “is”. I think it all hinges on a few technicalities and how you define constitutional. Back in 2010 when The Patient Protection and Affordable Care Act, or Obamacare, went before the Supreme Court of The United States. They agreed to uphold Obamacare under one condition: that it be defined as a tax. Technically, this makes it unconstitutional, as tax legislation is supposed to start in the house of representatives, but Obamacare started in the Senate. Score: Unconstitutional 1, Constitutional 0. As the President originally presented Obamacare to the Supreme Court, it was ruled unconstitutional because it gave the Congress power to regulate interstate commerce. Unconstitutional 2, Constitutional 0. Obamacare is also a direct tax, which is directly prohibited by the constitution.
